1. Acceptance of Terms & Eligibility

These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("User", "you", or "your") and MyBreadcrumbs ("Company", "we", "us", or "our"), governing your access to and use of the MyBreadcrumbs website (mybreadcrumbsapp.com), progressive web application, and iOS and Android mobile applications (collectively, the "Service").

By creating an account, forwarding itineraries, downloading, or using the Service, you represent and warrant that:

• You are at least 13 years of age (or 16 years of age in the European Economic Area / UK). If you are under the legal age of majority in your jurisdiction, you have obtained verifiable parental or legal guardian consent to agree to these Terms.
• You have the legal capacity and authority to enter into this binding Agreement.
• Your access to and use of the Service complies with all applicable local, national, and international laws and regulations.

2. Description of Service & Limited License

MyBreadcrumbs provides an interactive 3D Earth globe visualization, travel journaling, route plotting, flight mapping, expedition statistics tracking, AI itinerary ingestion, travel reel video generation, and digital passport milestone tools for personal, non-commercial use.

Subject to your strict compliance with these Terms, we grant you a personal, worldwide, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service on devices you own or control.

3. Account Registration, Security & Passwords

To use cloud sync, digital passport sharing, and email forwarding, you may register an account using supported third-party providers (Google OAuth) or email credentials.

• Credential Confidentiality: You are solely responsible for maintaining the confidentiality and security of your account credentials (including passwords). You are strictly responsible for all activity that occurs under your account.
• Re-Authentication on Password Change: In-app password modifications strictly require current password verification.
• Notification of Unauthorized Access: You agree to notify us immediately at support@mybreadcrumbsapp.com if you suspect any unauthorized access, compromised passwords, or security breaches.
• Emergency Account Lockout: When a password change notification is received, clicking Secure My Account allows you to immediately trigger account recovery and reset credentials.
• Guest Mode: When using the Service without creating an account, your travel data is stored solely in local device storage and will be permanently lost if your local storage or browser cache is cleared.

4. Inbound Email Forwarding & AI Itinerary Processing

MyBreadcrumbs offers an automated travel ingestion feature enabling users to forward booking confirmations, receipts, and e-ticket documents to trips@mybreadcrumbsapp.com or paste confirmation text into our import tool:

• User Representation & Warranty: By forwarding any email, confirmation, or document attachment to the Service, you represent and warrant that you own the email address, or have explicit, legally binding permission from all travelers identified in the document to process, parse, and log the itinerary within your account.
• AI Extraction & Accuracy Disclaimer: Automated itinerary parsing utilizes third-party artificial intelligence models (Google Gemini). Artificial intelligence parsing is provided strictly on an "as-is" and "as-available" basis. Extracted flight numbers, routes, times, dates, layover sequences, and airport codes may contain inaccuracies, omissions, or errors. You are solely responsible for reviewing and verifying all parsed travel data before relying upon it.
• Not a Booking Agent or Airline Confirmation: MyBreadcrumbs is a post-booking visualization and personal logging application. It is NOT an airline reservation system, travel agency, or official booking provider. Logging an itinerary in MyBreadcrumbs does not alter, confirm, cancel, or guarantee any commercial reservation. Always consult your airline or travel provider for official status.
• Prohibited Email Pipeline Uses: The email forwarding pipeline is exclusively intended for legitimate, personal travel confirmations. You agree NOT to forward spam, bulk marketing emails, phishing lures, malicious PDF attachments, non-travel documents, or high-volume automated feeds to trips@mybreadcrumbsapp.com. We reserve the right to immediately throttle, block, or permanently blacklist any sender address violating this standard.
• Linked Forwarding Addresses: Adding secondary forwarding emails requires passing a 6-digit cryptographic verification code (OTP). Attempting to verify or link an email address you do not control or are not authorized to use is strictly prohibited.

5. Travel Reel Studio & Media Exports

The Service provides a 9:16 vertical travel recap video studio for generating social media reels:

• User-Generated Video: Video generation and canvas rendering occur client-side on your device. You retain ownership of your exported videos.
• Soundtrack Licensing: Pre-loaded background audio tracks are licensed strictly for personal, non-commercial use as synchronized background audio in travel recap reels. You may not extract, isolate, resell, distribute, or publicly perform the standalone audio tracks outside of the context of a generated travel video.

6. Critical Aviation, Navigation & Geolocation Disclaimers

You explicitly acknowledge and agree that:

• Not for Aviation or Maritime Pilotage: Flight paths, Great Circle geodesic arcs, nautical miles, distances, route polylines, altitudes, bearings, and duration calculations displayed in the Service are visual approximations and mathematical estimates. The Service must NEVER be used for live aircraft navigation, flight planning, piloting, air traffic management, maritime navigation, route clearance, or any safety-critical application.
• Geographic & Border Classifications: While we endeavor to maintain accurate airport (IATA/ICAO) and city databases, geographic borders, territories, and naming conventions are provided for illustrative mapping only and do not express any political opinion regarding disputed territories or sovereignty.
• Travel Restrictions & Visas: The Service does not provide immigration, visa, customs, or health advisory information. You are solely responsible for verifying international travel requirements with relevant government agencies.

7. User Content & Intellectual Property

7.1 Your Content

You retain full ownership and intellectual property rights to all travel logs, trip notes, photos, itineraries, and custom metadata that you create, input, or upload to the Service ("User Content").

By submitting User Content to the Service, you grant MyBreadcrumbs a worldwide, royalty-free, non-exclusive license to host, store, copy, format, and display such content solely as necessary to operate, maintain, and deliver the Service to you and (if enabled by you) to others via public passport sharing.

7.2 Company Intellectual Property

All software code, 3D globe shaders, textures, Three.js rendering pipelines, graphics, logos, trademarks, animations, audio compositions, algorithms, and documentation comprising the Service are the exclusive property of MyBreadcrumbs and its licensors, protected by copyright, trademark, and other applicable intellectual property laws. You may not copy, modify, distribute, sell, reverse engineer, decompile, or create derivative works of any part of our technology without prior written authorization.

8. Acceptable Use & Prohibited Conduct

You agree that you will NOT:

• Use the Service for any unlawful, deceptive, fraudulent, or harassing purpose.
• Attempt to probe, scan, breach, or bypass any security or authentication measures, including PostgreSQL Row-Level Security (RLS) policies.
• Scrape, crawl, harvest, or extract data from the Service using automated means without explicit written consent.
• Overburden, flood, or disrupt our servers, AWS SES mail routes, or connected API infrastructure.
• Upload viruses, worms, malware, or destructive code.
• Impersonate any person or entity, or falsely claim affiliation with any individual, airline, or organization.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. MYBREADCRUMBS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, TIMELINESS, UNINTERRUPTED AVAILABILITY, SYSTEM INTEGRATION, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE, ITS SERVERS, AI EXTRACTION ACCURACY, OR EMAILS SENT FROM US ARE FREE OF VIRUSES OR HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYBREADCRUMBS, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, FLIGHT CANCELLATIONS, MISSED CONNECTIONS, BORDER EXPULSIONS, TRAVEL DISRUPTIONS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT ACTUALLY PAID BY YOU TO MYBREADCRUMBS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).

11. Indemnification

You agree to defend, indemnify, and hold harmless MyBreadcrumbs, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Service; (b) your User Content or forwarded travel itineraries; (c) your violation of these Terms; or (d) your violation of any third-party right, including any copyright, property, or privacy right.

12. Account Termination & Suspension

You may terminate this Agreement at any time by permanently deleting your account in Settings ➔ Account ➔ Delete Account. We reserve the right to suspend or terminate your account or access to the Service immediately and without prior notice if you violate these Terms or engage in conduct harmful to other users or our platform.

13. Dispute Resolution, Governing Law & Binding Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Binding Individual Arbitration & Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding, individual arbitration administered under the Commercial Arbitration Rules of the American Arbitration Association (AAA), rather than in court, except that you may assert claims in small claims court if your claims qualify. You and MyBreadcrumbs agree that all claims must be brought in each party's individual capacity, and NOT as a plaintiff or class member in any purported class, collective, or representative proceeding.

14. Changes to Terms

We reserve the right to modify or update these Terms at any time. When modifications are made, we will update the "Last Updated" date at the top of this document. Continued use of the Service after any such modifications constitutes your acceptance of the updated Terms.
