1. Acceptance of Terms

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and MyBreadcrumbs ("Company", "we", "us", or "our"), governing your access to and use of the MyBreadcrumbs website (mybreadcrumbsapp.com), progressive web application, and iOS / Android mobile applications (collectively, the "Service").

By creating an account, accessing, downloading, or using the Service, you represent and warrant that:

• You are at least 13 years of age (or 16 years of age in the European Economic Area / UK). If you are under the legal age of majority in your jurisdiction, you have obtained verifiable parental or legal guardian consent to agree to these Terms.
• You have the legal capacity and authority to enter into this Agreement.
• Your use of the Service does not violate any applicable law, rule, or regulation.

2. Description of Service & License

MyBreadcrumbs provides a 3D Earth globe visualization, travel logging, route plotting, flight mapping, expedition statistics tracking, and digital passport milestone tools for personal, non-commercial use.

Subject to your continuous compliance with these Terms, we grant you a personal, worldwide, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service on devices you own or control.

3. User Accounts, Security & Authentication

To access cloud synchronization, persistent stats, and cross-device functionality, you may register an account using supported third-party identity providers (e.g., Google OAuth) or email credentials.

• Account Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.
• Account Security: You are responsible for safeguarding your login credentials and for all activities occurring under your account. You must immediately notify us of any unauthorized use or security breach.
• Guest / Local Mode: When using the Service without creating an account, your data is stored solely in local device storage and may be lost if browser cache or application data is cleared.

4. Critical Aviation, Navigation & Geolocation Disclaimers

You explicitly acknowledge and agree that:

• Not for Real Navigation or Aviation: Flight paths, airport coordinates, Great Circle geodesics, nautical miles, distances, route polylines, altitudes, and time calculations displayed in the Service are approximations and mathematical estimates. The Service must NEVER be used for real-time aviation navigation, flight planning, piloting, maritime passage, emergency routing, or any safety-critical application.
• Airport & Destination Data: While we strive for accuracy, airport codes (IATA/ICAO), city coordinates, time zones, country borders, and geographic classifications may contain inaccuracies, historical changes, or typographical errors.
• Celestial Stats & Planetary Benchmarks: Earth lap calculations, Moon/Mars distance milestones, and celestial exploration rankings are playful visual metrics and gamified estimations.

5. User Content & Intellectual Property

5.1 Your Content

You retain full ownership and intellectual property rights to all travel logs, trip notes, photos, itineraries, and custom metadata that you create, input, or upload to the Service ("User Content").

By submitting User Content to the Service, you grant MyBreadcrumbs a worldwide, royalty-free, non-exclusive license to host, store, copy, modify, transmit, format, and display such content solely as necessary to operate, maintain, and deliver the Service to you and (if enabled by you) to other travelers via public passport sharing.

5.2 Company Intellectual Property

All software code, user interface designs, 3D globe shaders, textures, graphics, logos, branding, badges, algorithms, documentation, and trade dress comprising the Service are the exclusive property of MyBreadcrumbs and its licensors, protected by copyright, trademark, and other applicable intellectual property laws. You may not copy, modify, distribute, sell, reverse engineer, decompile, or create derivative works of any part of our technology without prior written consent.

6. Acceptable Use & Prohibited Conduct

You agree that you will NOT:

• Use the Service for any unlawful, fraudulent, or malicious purpose.
• Attempt to probe, scan, breach, or bypass any security or authentication measures, including PostgreSQL Row-Level Security (RLS).
• Scrape, crawl, harvest, or extract data from the Service using automated means (such as bots, spiders, or scrapers) without written permission.
• Interfere with, overburden, or disrupt the operation of our servers, networks, or connected API infrastructure.
• Upload viruses, malware, or destructive code.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation.
• Reverse engineer, decompile, or disassemble any aspect of the application source code or proprietary algorithms.

7. Third-Party Services, APIs & Advertisements

The Service integrates with and relies on trusted third-party providers:

• Authentication & Database: Supabase and Google OAuth for authentication and database infrastructure.
• Advertisements: Google AdMob and Google AdSense for in-app or web banner advertising. Advertisers are solely responsible for their promotional content. We do not endorse or guarantee third-party products advertised.
• External Links: The Service may contain links to external third-party websites. We are not responsible for the content, privacy practices, or availability of third-party platforms.

8. In-App Purchases, Subscriptions & Monetization

We may offer optional premium features, ad-removal upgrades, or subscription tiers in future releases. All fees, billing terms, cancellation policies, and refund rules will be clearly disclosed prior to purchase. Purchases made through the Apple App Store or Google Play Store are subject to Apple’s and Google’s respective payment terms.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. MYBREADCRUMBS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, SYSTEM INTEGRATION, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYBREADCRUMBS, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, FLIGHT CANCELLATIONS, TRAVEL DISRUPTIONS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT ACTUALLY PAID BY YOU TO MYBREADCRUMBS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).

11. Indemnification

You agree to defend, indemnify, and hold harmless MyBreadcrumbs, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your infringement of any intellectual property or privacy right of any third party.

12. Account Termination & Suspension

You may terminate this Agreement at any time by deleting your account through the in-app Settings menu and ceasing all use of the Service. We reserve the right, in our sole discretion, to suspend or terminate your account or access to the Service immediately and without notice if you violate these Terms or engage in conduct harmful to our users or platform.

13. Dispute Resolution, Governing Law & Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Arbitration & Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding, individual arbitration rather than in court, except that you may assert claims in small claims court if eligible. You and MyBreadcrumbs agree that all claims must be brought in each party's individual capacity, and NOT as a plaintiff or class member in any purported class, collective, or representative proceeding.

14. Changes to Terms

We reserve the right to revise or update these Terms at any time. When modifications are made, we will update the "Last Updated" date at the top of this document. Continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
